DUI defense attorneys in Sarasota and Manatee counties have been successful in getting hundreds of breath tests thrown out due to the unreliability of the Intoxilyzer 5000. The breath test machine has been used for two decades in Florida and the results from the machine helped to convict thousands of Florida driver’s charged with DUI. Recent rulings though have shown that the tests from the machine cannot be trusted and it has been replaced by a newer version now, the Intoxilyzer 8000.
While judges in Sarasota and Manatee have recognized the problems in recent cases with the Intoxilyzer 5000, it doesn’t seem that anything will be done for older cases that hinged on the results from this machine. According to Todd Ruger in The Herald Tribune there will be no second chance for older convictions.
