DUI Manslaughter-Drugs Charges Filed Against Osceola Motorist After UF Examines Blood Sample

The Florida Department of Law Enforcement had chemists look at a blood sample from David Lanier following a deadly car accident in St. Cloud, Florida. The FDLE investigation led to DUI manslaughter charges being dropped as the tests could not determine the amount of cocaine in the driver’s system. That didn’t stop prosecutors from running another set of tests at the University of Florida and now they are filing new DUI manslaughter charges. The only problem is they can’t find Lanier now.

Florida Attorney Discusses DUI-Drugs

Police originally charged Lanier with the DUI charges as they believed he was impaired due to his cocaine use. Lanier admitted to using cocaine but he said the last time he took the drug was three days before the accident. A search of his car turned up marijuana, drug paraphernalia and syringes with coke residue. FDLE tests found cocaine and Xanax in Lanier’s system…

Florida DUI Checkpoint – The FHP Will Have A DUI Checkpoint Set Up IN Pasco County Friday

TampaBay.com is reporting that the Florida Highway Patrol will set up a Pasco County DUIcheckpoint Friday night from 7:00 p.m. – 3:00 a.m. The Pasco County Sheriff’s office will join other law enforcement agencies in an attempt to arrest drunk drivers and drivers under the influence of drugs.

The checkpoint will be on U.S. Highway 41 and Hale Road. They will not only be looking for drunk drivers but also checking for drivers without proper insurance information or registrations. Polk City DUI Charges May Be Coming For Man Who Was Drunk And On Meth When He Hit A Bicyclist

A Polk City man may soon be in need of the services of a
DUI lawyer after admitting to police he was drunk and on crystal meth at the time he struck and nearly killed a bicyclist. Michael Waters has been arrested on charges of possession of a firearm by a convicted felon, leaving the scene of an accident with serious bodily injury and driving with a
suspended license as a habitual traffic offender. DUI charges are still pending as investigators wait on results from blood and urine tests.

Waters rear ended Norman Shepherd who was riding his bike on Cass Road. The crash left Shepherd in critical condition at Lakeland Regional Medical Center. Polk County Sheriff’s deputies found Waters and brought him back to the scene of the accident. Inside his van was a beer and a loaded .22 caliber rifle.

Fourth DUI Charge Since 2001 For Venice Middle School Music Teacher

A Sarasota County music teacher was arrested Sunday for the fourth time since 2001 on drunk driving charges. Ronald Jodwalis has been convicted twice on DUI charges and has now been arrested for DUI on two other occasions. The Venice Middle School music teacher had a blood-alcohol level of 0.30 and is now in Sarasota County jail on charges of driving with a suspended license and DUI.

The arrest began when a deputy was alerted that a car was swerving on a Sarasota County road. Jodwalis was tracked down at a gas station. According to the Sarasota Herald Tribune the man was eating the plastic wrapper of a sandwich when cops pulled up to him. The 52-year-old suspect allegedly admitted to drinking and could not stand up. His blood-alcohol level was later determined to be nearly four-times the legal limit.

Tampa Man With Blood Alcohol Level Three Times The Limit Charged With DUI Manslaughter

Paul Michael Parks turned himself in on charges of DUI manslaughter and two counts of driving under the influence with property damage or personal injury. Weaver was involved in a head-on collision that killed 47-year-old Karen Weaver on December 19. According to the Brandon News the Lithia man had a blood-alcohol level of 0.218 at the time of the fatal accident.

Parks’ bail was set at $25,000 by a Hillsborough County Judge. The crash took place on Big Bend Road. The vehicles collided and hit a third car. Weaver, a Riverview resident, died at the scene. Parks was injured and taken to Tampa General Hospital.

Clearwater Man Sentenced To 15 Years In DUI Manslaughter After Killing Elderly Man On A Scooter

Pinellas County judge> has sentenced a Clearwater man to 15 years for a drunk driving accident that claimed the life of an elderly man crossing a street on a mobility scooter. Angus T. Davis III pled guilty to DUI manslaughter, which is <second DUI conviction. He received his first DUI in 1992.

The DUI manslaughter charges stem from a December 2007 accident where David ran over a decorated World War II Army veteran. Jack Schaffer was crossing a Clearwater street on his mobility scooter when Davis hit him. The 84-year-old man participated in the invasion of Normandy. After the crash, Davis registered a blood-alcohol level of 0.348.

Intoxilyzer 8000 Under Fire Once Again In DUI Cases Inside Florida Courtrooms

The battle lines are being drawn for a crucial fight over breath tests in about 300 drunk driving cases in Palm Beach County. At the heart of the matter is the controversial Intoxilyzer 8000 breath test machine. The machine has already faced stiff legal challenges in courtrooms in Sarasota and Manatee counties which resulted in hundreds of breath test results being excluded. Now lawyers in Palm Beach County are challenging the Intoxilyzer once again.

DUI defense attorneys in Palm Beach are claiming the Intoxilyzer 8000 is not legal because Florida’s version of the breath tests machine differs from federally approved models, according to a story by the Palm Beach Post. The lawyers also say they have evidence that the Intoliyzer’s failed inspections and that was covered up by law enforcement.
