DUI Stop In Bardenton Leads To A Brief, Low-Speed Pursuit By PoliceLast night Manatee County Sheriff’s attempted to stop the driver of a car they suspected was driving drunk. They witnessed a car pull out of a parking lot and into oncoming traffic. The car almost caused a traffic accident. At that point deputies attempted to stop the car for a potential DUI and conduct field sobriety tests. The driver of the car, 60-year-old Placido Castanada-Floires, did not stop and led deputies on a brief and slow car chase. The officers used “stop sticks” in an attempt to blow out the car’s tires and stop the driver. It eventually worked but not until Castanada-Floires had driven two more blocks. The man, who was driving on a suspended license, was arrested and booked into Manatee County jail. December 15, 2009
Sarasota Judge Selected To Lead The State’s DUI Adjudication LabThere is no bigger hot spot for the issues surrounding breath tests in DUI cases than Sarasota, Florida. Defense Attorneys in this part of the state have had great success in having 100’s of breath tests excluded due to the Intoxilyzer machines utilized in the area. It has been very frustrating for prosecutors in these DUI cases. With so much information coming from this part of the state it seemed to make perfect sense that Sarasota County Judge Kimberly Carlton Bonner was selected to spend the next three years leading the state’s DUI Adjudication Lab, according to the Sarasota Herald Tribune’s Todd Ruger. The lab is set up to educate Florida judges about DUI cases. Included is an intensive week-long course with judges that examines all issues related to traffic DUI cases. No Second Chance For Those Convicted Of DUI In Intoxilyzer 5000 CasesDUI defense attorneys in Sarasota and Manatee counties have been successful in getting hundreds of breath tests thrown out due to the unreliability of the Intoxilyzer 5000. The breath test machine has been used for two decades in Florida and the results from the machine helped to convict thousands of Florida driver’s charged with DUI. Recent rulings though have shown that the tests from the machine cannot be trusted and it has been replaced by a newer version now, the Intoxilyzer 8000. While judges in Sarasota and Manatee have recognized the problems in recent cases with the Intoxilyzer 5000, it doesn’t seem that anything will be done for older cases that hinged on the results from this machine. Honor Student At MTI Killed In Crash On U.S. 301 As Alcohol Is Suspected To Have Played A RolePolice in Manatee County believe a drunk driver may be at fault in a car crash that took the life of a Manatee Technical Institute honor student according to a story on the Bradenton Herald’s website. Henrique Romero Graf was killed Sunday when his van was struck from behind on Tallevast Road. The accident took place at approximately 1:15 a.m. Sunday morning. According to the Florida Highway Patrol the crash was caused by Mary Zimmerman who suffered minor injuries when her car straddled the center line and struck the right side of Graf’s van. The van then rolled over the median into northbound traffic lanes. Troopers suspect Zimmerman was driving drunk and tests will be done to determine if she was impaired. |
