DUI Cases In Palm Beach Move Forward After Intoxilyzer Challenge Is Rejected By Judges

Palm Beach County DUI defense lawyers failed in their attempt to persuade a panel of seven county judges that the Intoxilyzer 8000 is not an approved instrument in Florida for accurately measuring blood-alcohol levels. The unanimous ruling clears the way for Palm Beach County to proceed in prosecuting more than 400 drunk driving cases.

The DUI defense attorneys asserted that the Intoxilyzer 8000 was not an approved breath test instrument and the people in charge of maintaining and inspecting the breath-test machines destroyed evidence of failed inspections. The judges did not buy either argument. DUI defense attorneys in Palm Beach County will continue to pursue the case as they believe the maker’s of the Intoxilyzer 8000 is refusing to provide key information about the operation of the breath tests machine.

DUI Charges Filed Against Daughter Of Florida Supreme Court Justice

Stephanie Labarga, the daughter of a Florida Supreme Court Justice, has been arrested on charges of DUI in Palm Beach County. The 23-year-old from Wellington had a blood alcohol content
measuring twice the legal limit according to the Palm Beach Post. Officers report stopping her for speeding and noticing she had bloodshot eyes and smelled strongly of alcohol . She apparently admitted to drinking and begged the officer to let her go.

Labarga blew a 0.173 and 0.177 following her arrest. She was allegedly driving over the speed limit with her blinker on. She was stopped after 1:30 a.m. and booked into jail around 4:00 a.m. Her father was a former Palm Beach County Circuit Judge and became famous for refusing a new vote in the hotly debated 2000 presidential election between Al Gore and Gorge W. Bush.
